Servus Peru E.I.R.L. (hereinafter referred to as S.P.) is committed to protecting and safeguarding the personal data of users in accordance with the Personal Data Protection Law – Law No. 29733 – and its corresponding regulations, as approved by Supreme Decree No. 003-2013-JUS (the Regulations on the Protection of Personal Data).

In this regard, the present policy pursues the following objectives:

  • To establish general guidelines for the processing and disclosure of personal data belonging to data subjects, such as employees, users, clients, and suppliers of Servus Peru E.I.R.L.

  • To ensure that S.P. complies with the provisions set out in the legislation governing the protection of personal data.

Definitions:
APDP: National Authority for the Protection of Personal Data.

Information Asset: Any physical document (PD), digital document (DD), or computer application (APP) that holds value for S.P. and/or supports or forms part of the organisation’s activities, processes, or business areas.

IT Application outside the custody of the Systems Department (AppnoIT): Any information resource aimed at data processing and management, which is administered by a department and hosted either within that same department or the Systems Department. This definition includes digital files with embedded programming logic, such as Access databases, SharePoint workflows, and others.

Data Collection, Use and Disclosure

Personal database: This term refers to a structured collection of personal data, whether automated or not, across any medium, including physical, magnetic, digital or other formats. It encompasses all aspects of data creation, formation, storage, organisation and access.
 Consent: The data subject has given their authorisation for the controller to process and/or transfer the personal data.
 Personal data: Information of any type that identifies or can be used to identify a natural person directly or indirectly, including numerical, alphabetical, graphic, photographic, acoustic or personal data. For example, the following information is required: first and last name, DNI/RUC, passport, gender, profession, age, nationality, date of birth, address, telephone, email, photograph, signature, voice, etc.

Sensitive data: Personal data relating to physical, moral or emotional characteristics; facts or circumstances relating to affective or family life; personal habits relating to intimate life; information concerning physical or mental health; biometric data suitable for the sole purpose of identifying the holder; data concerning racial or ethnic origin; economic income; political, religious, philosophical or moral beliefs or opinions; trade union membership; information concerning health or sex life; or any other data relating to the privacy of the natural person.
 Digital Document (DD): Information assets are defined as any electronic data that requires a computing device to access and retrieve it. Please note that this definition excludes any digital file containing programming logic, such as Excel macros.

Physical document (FD): Information assets are defined as any data recorded in a tangible format. Such assets may include cash receipts, operational control documents, active documents, passive documents, and documents for physical archiving, amongst others.
 Controller of the personal data database: A natural person, a legal person governed by private law, or a public body that carries out the processing of personal data on behalf of the personal data controller, either alone or jointly with another.
 The individual listed here is the data controller for personal data. The natural person to whom the personal data relates.

This includes any automated or non-automated operation or technical process that involves the collection, recording, organisation, storage, retention, processing, alteration, retrieval, consultation, use, blocking, erasure, disclosure by transmission or dissemination, or any other form of processing that facilitates the access, association or combination of personal data.

Any transfer, provision or disclosure of personal data at national or international level to a legal person under private law, to a public body or to a natural person who is not the controller. Disclosure, dissemination or any other form of processing that facilitates the access, correlation or linking of personal data is not deemed to be a transfer.

This includes only use by SP (the owner of the personal data database) and will not be sold, transferred or rented to third parties without the express consent of the persons who have entered their data. We are committed to safeguarding the confidentiality of the information provided by our visitors. Users can access the information on our website without the need to provide any personal data. In the event of an e-mail enquiry, a reservation or the purchase of our services, the personal data you provide will be included in a database and managed by Servus Perú E.I.R.L.. This data will be used exclusively to provide the information you have requested and to offer you the benefits associated with the fulfilment of this information.
